TERMS OF SERVICE

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your participation in any driving experiences, track day events, and related services provided by Race Competitions Ltd ("Race Competitions," "we," "us," or "our"). By booking, purchasing, or participating in a Race Competitions event or service, you agree to these Terms as a binding agreement. Please read them carefully. If you do not agree with any part of these Terms, you should not make a booking or purchase with us.

2. Scope of Application

These Terms apply to all standard Race Competitions events and services (including individual driving experiences and gift voucher purchases) offered to the general public. Private Circuit Hire arrangements and bespoke Corporate Events are excluded from these standard Terms of Service; such private or corporate bookings are governed by separate custom contracts agreed in writing with Race Competitions. If you are booking a Private Circuit Hire or a tailored Corporate Event, refer to your specific contract for applicable terms, as those will override any conflicting terms here.

3. Bookings, Payments, and Deposits

  • Booking Confirmation: A booking is confirmed once the required payment (or deposit, if applicable) has been received and Race Competitions issues a confirmation. All prices are in GBP and include any applicable VAT unless stated otherwise.

  • Full-Day Experience - Payment Structure: When booking a Full-Day Race Car Experience, the first £750 of your total booking fee is strictly non-refundable, regardless of whether it is paid as a deposit or as part of a full upfront payment. This amount secures your event date and covers the commitment of resources necessary to facilitate your experience. Any remaining balance beyond this amount must be paid according to the payment schedule outlined in your booking confirmation.

  • Date Changes for Full-Day Experiences: If you need to reschedule a confirmed full-day event, you must notify us in writing as soon as possible. While the £750 deposit remains non-refundable, we may, at our sole discretion, allow a new date to be arranged. Rescheduling Fee: Race Competitions Ltd reserves the right to charge a rescheduling fee for date changes, especially if the request is made on short notice (e.g., within 30 days of the event) or if multiple changes are requested. Any such fee will be communicated to you before confirming the new date.

  • “Stint” Driving Experiences: Purchases of Stint (shorter driving experience) products are non-refundable. However, if you give at least 30 days’ notice before your scheduled Stint event date, you are entitled to one free reschedule of that booking to an available future date. To use this one-time free reschedule, you must contact us in writing at least 30 days prior to your original event date. If a rescheduling request for a Stint is made with less than 30 days’ notice, Race Competitions may still accommodate a new date at its discretion, but we reserve the right to charge a rescheduling fee under those circumstances. We will inform you of any such fee, and payment of it will be required to confirm the new date.

  • No-Show and Late Arrivals: If you do not attend your booked event or arrive too late to participate, it will be treated as a cancellation on your part. In such cases, no refund will be provided for any fees paid (including deposits), and any rescheduling will be at Race Competitions’ discretion (additional fees may apply). We strongly advise arriving at the event location at the recommended check-in time to avoid missing your session.

4. Gift Vouchers

Race Competitions offers vouchers for driving experiences which can be redeemed by the holder for a future event booking:

  • Validity: Vouchers are valid for the period stated at purchase (if not stated, default validity is 365 days from purchase date). They must be redeemed (used to book an event) before the expiry date.

  • Refund Policy for Vouchers: A voucher purchase is refundable within 30 days of the purchase date, provided the voucher has not been redeemed or used to book an event. After 30 days from the purchase date, or once the voucher has been redeemed (whichever occurs first), the voucher becomes non-refundable. This means if more than 30 days have passed since purchase or if the voucher code has been applied to an event booking, you are not eligible for a refund on that voucher.

  • Transferability: Vouchers are generally transferable to another person, meaning the named recipient can be changed, provided that the new recipient meets all eligibility requirements for participation in our experiences. However, selling a voucher or using it for commercial promotional purposes without our explicit consent is strictly prohibited. If you sell or distribute a Race Competitions Ltd voucher without our authorisation, you will be liable to pay us the full retail price of that/those product(s) for each instance in which you have sold one. For example, if you sell three £299 vouchers to someone else for £10 each, you must pay us 3 × £299 (£897 total) to cover the full retail value. This applies regardless of the price at which you sold the vouchers. Additionally, you are responsible for ensuring that the person you transfer a voucher to meets all eligibility requirements for participation in our experiences, including but not limited to age, driving licence, and medical fitness requirements. If a voucher is transferred to someone who is ineligible to participate, we will not issue a refund or replacement on the grounds that the new recipient does not meet our eligibility criteria. The responsibility for verifying eligibility lies solely with the original purchaser or transferor of the voucher. By transferring a voucher, or accepting a voucher being transferred to you, you agree to these terms and accept full responsibility for any consequences arising from unauthorised resale or transfer to an ineligible participant.

     

     

  • Extension: If you are unable to use a voucher before it expires, contact us in advance of the expiry date. Extensions may be granted at Race Competitions’ discretion (an extension fee may apply). Once a voucher has expired, it holds no value and cannot be redeemed, transferred or refunded.

5. Optional Upgrades and Additional Services

We offer various optional add-ons to enhance your experience, such as photography packages, video footage, and passenger ride experiences. These optional upgrades are typically purchased either when booking your event or on the event day:

  • Optional Upgrade Purchases: All optional add-on services (for example, in-car video recording, professional photographs, extra passenger ride-along sessions, etc.) must be paid in full at the time of adding them to your booking.

  • Refund Policy for Upgrades: Optional upgrades are refundable within 30 days of purchase only if the service has not yet been delivered or fulfilled. If 30 days have passed since you purchased the upgrade, or if the upgrade service has already been provided (whichever comes first), then the cost of that upgrade is non-refundable. For example, if you purchase a photo or video package, once the media files have been produced/delivered to you (which may be on or shortly after your event date), no refund will be given on that package; similarly, a passenger ride add-on is not refundable after the ride has taken place or after 30 days from purchase, even if not yet used. This excludes damage waivers, which are not 'upgrades' and are non-refundable.

  • Undelivered Add-Ons: If an upgrade (such as a passenger ride or media package) cannot be delivered on the event day due to timing or operational constraints, we will either offer to reschedule that specific service or provide a refund for that upgrade at our discretion. This clause applies only to the undelivered upgrade, not to the main event booking.

6. Damage Waiver

Race Competitions may offer an optional Damage Waiver for purchase, which is designed to limit your financial liability for damage to vehicles during the event:

  • Coverage: If you purchase the Damage Waiver, subject to its terms and conditions, you will not be held responsible for the majority of repair costs in the event you accidentally damage the vehicle you are driving. (Certain exclusions may apply, such as damage caused by reckless or intentional misconduct, which would not be covered by the waiver. Details will be provided in the waiver agreement you sign on the event day.)

  • Non-Refundability: The fee for the Damage Waiver is non-refundable once purchased. This is true in all circumstances, regardless of whether you actually attend or drive in the event, and regardless of any event cancellations or rescheduling. 

  • Optional Nature: Purchasing the Damage Waiver is optional unless otherwise specified for a particular event. However, if you choose not to purchase the Damage Waiver, you accept full, unlimited financial liability for any and all damage you cause to the vehicle during your session. This liability extends beyond just the cost of repairs and includes the full cost of repair, including parts and labour at the applicable specialist rates, associated VAT and taxes, transport fees associated with moving the vehicle to and from repair facilities, refunds or compensation owed to other customers if the vehicle is rendered unavailable, fees incurred to reschedule all or part of an event due to the vehicle being out of action, additional operational costs arising from the vehicle’s damage or downtime, and any consequential loss, including but not limited to loss of sales, revenue, or profit due to the vehicle’s unavailability. We strongly recommend purchasing the Damage Waiver to limit your liability and provide financial peace of mind. Without a waiver, your liability is unlimited and extends to all financial losses suffered by Race Competitions Ltd as a result of the vehicle being out of service. By declining the Damage Waiver, you accept this full financial responsibility without limitation.

7. Participant Eligibility and Conduct

To ensure safety and compliance, all participants must meet and adhere to the following requirements:

  • Driver’s License: You must hold a valid manual driving license appropriate for the vehicle and event (e.g., a full UK driving license or an international equivalent acceptable in the UK). You must bring the original physical license (and any required counterpart or documentation) to the event for verification. Failure to present a valid license will result in you being unable to drive, and this will be treated as a no-show/cancellation on your part with no refund.

  • Age and Physical Condition: Participants must meet any age requirements specified for the experience (for example, a minimum age to drive). Any height, weight, or health restrictions will be communicated prior to booking – you are responsible for ensuring you comply with these. If you have any medical conditions or disabilities that may affect your ability to safely participate, please inform us in advance. We will make reasonable accommodations if possible, but reserve the right to decline participation if we believe safety could be compromised. It is your responsibility to ensure that you bring any necessary medical apparatus (for example, an inhaler, insulin, etc). 

  • Safety Briefing and Waivers: All participants must watch the pre-event safety briefing and sign the required waivers/releases (including a liability waiver and confirmation of insurance or Damage Waiver choice) before driving. These waivers outline the inherent risks of high-performance driving and confirm your acceptance of those risks. If you refuse to sign the necessary waivers or skip the safety briefing, you will not be allowed to participate and no refund will be given.

  • Equipment and Attire: We will provide any specialised safety equipment required (such as helmets). You must wear appropriate attire (e.g., closed-toe shoes and comfortable clothing suitable for driving) as advised in your pre-event information pack. Follow all instructions regarding safety gear.

  • Conduct and Compliance: You are expected to follow all instructions given by Race Competitions staff and instructors at all times. This includes adherence to track rules, speed limits in pit lanes, and all flags or signals during the driving session. Dangerous, reckless, or discourteous behavior will not be tolerated.

  • Right to Refuse or Remove: Race Competitions Ltd reserves the right to refuse service to, or immediately remove from an event, any person who:

    • Does not meet the eligibility criteria or fails to provide required documentation.

    • Is suspected to be under the influence of alcohol or drugs (zero-tolerance policy; breathalyser tests may be administered at our discretion).

    • Behaves in an inappropriate, unsafe, or disruptive manner, including failing to adhere to staff instructions or track rules.

    • Harasses, threatens, or endangers any staff member or other participant.

    If you are refused participation or removed from the event for any of the above reasons (or similar misconduct/non-compliance), you will be ineligible for any refund, and no free rescheduling will be offered. Race Competitions will not be responsible for any consequential costs you incur due to such removal (e.g., travel or accommodation expenses).

8. Event Changes and Cancellations by Race Competitions Ltd

While we strive to run all events as scheduled, certain circumstances may require us to cancel or reschedule an event or modify the services provided:

  • Minimum Attendance and Weather: Some events may be subject to a minimum number of participants. If the minimum is not met, or if severe weather or other conditions beyond our control (e.g., natural disasters, pandemics, or venue issues) make it unsafe or impossible to proceed, we reserve the right to cancel or postpone the event.

  • Notification: In the event we must cancel or significantly change the date or location of your event, we will notify you as soon as possible using the contact information you provided at booking. We will provide information on rescheduling options or refunds as described below.

  • Cancellation by Race Competitions: If we cancel an event entirely (and do not offer an alternative date or location), you are entitled to a full refund of all fees you have paid for that event (including any deposit and add-ons for that booking), or, if you prefer, a credit or transfer to an alternative event (subject to availability and any difference in price).

  • Event Rescheduling: If we postpone or reschedule an event to a new date (for example, due to weather or venue issues), your booking will normally be honoured for the new date. If you cannot attend on the new date, you must inform us within the timeframe specified in our notice (we will give instructions in the notification). In such cases, you can choose either a refund of the event fees paid or a credit towards another event, per our instructions. Note that if an event is rescheduled and you do attend on the new date, your original booking terms (including any non-refundable conditions) continue to apply.

  • Vehicle Availability and Substitutions: Specific vehicle models are subject to availability. We will do our best to ensure that you drive the car you booked. However, if a particular vehicle becomes unavailable on the day (for example, due to a mechanical breakdown or because it was damaged by a previous participant), we will make reasonable efforts to provide a suitable alternative vehicle for your session. Driving an alternative vehicle in such circumstances does not entitle you to a refund, provided the experience delivered is of similar value.

  • Interruption Before Your Drive (Car Breakdowns/Damage): If the car you are scheduled to drive is unavailable before your session because it breaks down or is damaged (e.g., by another participant earlier in the day) and no alternative can be provided at that time:

    • We will not issue an immediate refund for that session. Instead, we will offer you a free reschedule for the missed drive in the same or an equivalent vehicle on a future date of your choice (subject to availability).

    • We will provide you with a voucher or confirmation for this rescheduled session, and you can re-book it at your convenience.

    • If, on the rescheduled date, the same issue occurs again such that you still cannot take your drive (for instance, the substitute or repaired car is again unavailable due to similar problems), then we will issue you a full refund for that portion of the experience.

  • No Further Liability: In the situations described above (vehicle breakdowns or event cancellations), Race Competitions Ltd.'s liability is limited to the rescheduling of the event/session or the refund of the fees paid for the affected event or service, as applicable. We are not liable for any additional costs, expenses, or losses you may incur as a result of a cancellation or delay, such as travel or accommodation expenses, or any other consequential loss. We recommend you consider flexible bookings for travel or lodging, or purchase appropriate travel insurance to cover such eventualities.

9. Limitation of Liability

  • Assumption of Risk: By participating in our high-performance driving experiences, you acknowledge that motorsport activities carry inherent risks. While we take every precaution to ensure safety, there is always the possibility of accidents or incidents. You agree that you understand these risks and are participating willingly, at your own risk.

  • Personal Injury and Property Damage: Race Competitions Ltd is not responsible for any personal injury or property damage that occurs during an event, except where such injury or damage is proven to result from our negligence. All participants will be required to sign waivers that confirm their understanding of this and that release Race Competitions from liability to the fullest extent permitted by law.

  • Damage to Vehicles: If you cause damage to a vehicle or equipment during your session and you have not purchased the Damage Waiver, you will be held liable for any and all associated costs. If you have purchased the Damage Waiver, your liability for vehicle damage will be limited in accordance with that waiver’s terms (notwithstanding exceptions for reckless or intentional acts, as noted). The waivers you sign will detail your responsibilities and liabilities.

  • Indirect or Consequential Losses: Under no circumstances will Race Competitions Ltd be liable for indirect losses or consequential damages such as loss of income, loss of enjoyment, or costs of traveling to an event (even if the event is cancelled or rescheduled). Our financial liability to you is strictly limited to refunding the applicable event fees paid or providing a rescheduled booking as set out in these Terms and our Refund Policy.

  • Total Liability Cap: Except in cases of death or personal injury caused by our negligence or other liability which cannot be limited by law, the total aggregate liability of Race Competitions Ltd for any claim arising out of or in connection with your booking or participation in an event shall not exceed the total amount you have paid us for that booking (including any add-on services).

  • Third-Party Services: If any part of your experience includes services provided by a third party (for example, catering at an event or facilities at a third-party venue), those services are subject to the third party’s own terms and liability. Race Competitions is not liable for the acts or omissions of third parties. We will, however, use reasonable care in selecting reputable partners and will assist in addressing any issues within our control.

10. Miscellaneous

  • Changes to Terms: Race Competitions Ltd reserves the right to update or modify these Terms of Service at any time. If we make material changes, we will provide notice (for example, by updating the effective date at the top of this document and/or informing customers via our website or email). It is your responsibility to review the Terms periodically. By continuing to use our services or maintain a booking after any changes, you accept the updated Terms.

  • Entire Agreement: These Terms, together with your booking confirmation, our Refund Policy (which is incorporated herein by reference and available on our website), and any other policies or documents expressly referred to herein, constitute the entire agreement between you and Race Competitions Ltd regarding your purchase and participation in our events. In the event of a direct conflict between these Terms and the Refund Policy, these Terms will govern for matters of participation and service provision, while the Refund Policy will govern for matters specifically related to refund eligibility and process.

  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed from the Terms and will not affect the validity and enforceability of the remaining provisions.

  • Governing Law and Jurisdiction: These Terms of Service and any disputes or claims arising out of or in connection with them (including non-contractual disputes) are governed by the laws of England and Wales. You and Race Competitions Ltd agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms or your participation in our events.
